Diversity Immigration Visa (DV): Understanding the Procedure
The Department of State issues an announcement in the Federal Register about the Diversity Visa (DV) program for the upcoming fiscal year. Individuals from eligible regions or countries can apply for the DV lottery following the guidance provided by the Department of State. Those who win the lottery are informed of their rank numbers by the Department. The available immigrant numbers for qualified DV category applicants are published in the Visa Bulletin.
U.S. lottery winners who are not restricted by Sections 245(a) and 245(c) can apply for a status adjustment. However, DV lottery cases cannot bypass the restrictions of 245(a) and 245(c) under Section 245. Eligibility to adjust status through the DV program is valid only until the fiscal year ends on September 30 of the selection year.
