Select Immigration Attorneys With Years of Expertise
In some situations, the Secretary of Homeland Security can grant a foreign country Temporary Protected Status (TPS) due to circumstances that make it unsafe for its citizens to return, or when the country cannot manage their return adequately. Nationals from those countries, or regions within those countries, who are currently in the United States, may be eligible to receive TPS from USCIS.
Individuals who lack nationality but previously lived in designated countries can also qualify for TPS. At the Patel Law Group, we boast nearly 20 years of expertise in assisting clients with immigration issues. When is TPS Status Applicable?
Temporary situations that might cause Homeland Security to classify a country as TPS include:
- Civil war or ongoing armed conflict
- Seismic activity, tropical cyclone, widespread illness, or another natural catastrophe
- Other extraordinary temporary conditions
Who Qualifies for Temporary Protected Status?
People who are TPS recipients, or those who are initially deemed eligible for TPS after a preliminary case review, during the specified timeframe:
- Are not removable from the U.S.
- You can get a work permit.
- May be granted travel authorization
TPS is a temporary benefit that does not result in obtaining permanent lawful resident status or any other type of immigration status. Nevertheless, TPS does not stop you from:
- Applying for a change in status due to an immigration petition
- Applying for non-immigrant status
- Applying for any other immigration benefit or protection you may qualify for.
